1. Agreement to Terms

By accessing or using VoxPilot's website and services, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and VoxPilot ("Company," "we," "our," or "us").

2. Description of Service

VoxPilot provides an AI-powered receptionist platform designed for real estate professionals. Our services include:

• Automated call answering and handling
• Lead capture and qualification
• Appointment scheduling and calendar management
• SMS follow-up messaging
• Call summaries and urgency notifications

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

3. Eligibility

You must be at least 18 years old and legally authorized to enter into binding contracts to use our services. By using VoxPilot, you represent and warrant that you meet these requirements.

4. Account Registration

To access certain features, you may need to create an account. You agree to:

• Provide accurate, complete, and current information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities that occur under your account

5. Acceptable Use

You agree not to use VoxPilot to:

• Violate any applicable laws or regulations
• Engage in harassment, fraud, or deceptive practices
• Collect data about callers without proper disclosures
• Violate telephone consumer protection laws (TCPA, FCC regulations, or equivalent)
• Interfere with or disrupt the service or its infrastructure
• Attempt to gain unauthorized access to any part of the service
• Use the service for any illegal or unauthorized purpose

6. Telephone and Call Recording Compliance

By using VoxPilot's call-handling features, you acknowledge and agree to:

• Comply with all applicable federal, state, and local laws regarding telephone communication and call recording
• Ensure proper disclosures are made to callers as required by applicable law
• Obtain any necessary consents before recording conversations
• Be solely responsible for your compliance with TCPA and similar regulations

7. Payment Terms

Subscription fees, pricing, and billing terms will be presented to you at the time of purchase. By subscribing, you agree to pay all applicable fees. Fees are non-refundable except as required by law or as stated in our refund policy. We reserve the right to change pricing with 30 days' notice.

8. Intellectual Property

All content, features, and functionality of the VoxPilot service — including but not limited to software, text, graphics, logos, and AI models — are the exclusive property of VoxPilot and protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the service for your business purposes in accordance with these Terms.

9. Data and Privacy

Your use of the service is also governed by our Privacy Policy. By using VoxPilot, you consent to the collection and use of your information as described therein.

You retain ownership of your business data. We process this data solely to provide the service and as described in our Privacy Policy.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR ACHIEVE ANY PARTICULAR RESULTS, INCLUDING LEAD CAPTURE OR CONVERSION RATES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOXPILOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO VOXPILOT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless VoxPilot and its officers, directors, employees, and agents from and against any claims, liabilities, damages, and expenses arising from your use of the service, violation of these Terms, or infringement of any third-party rights.

13. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to use the service ceases and we may delete your account data in accordance with our data retention policy.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the state in which VoxPilot is incorporated, without regard to conflict of law principles.

15. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of significant changes by updating the "Last updated" date and, where appropriate, by email. Continued use of the service after changes constitutes acceptance of the updated Terms.
